What kind of follow-up should I do if I’ve been rear-ended?

If you have been rear-ended, and particularly if there has been some substantial damage to your person or vehicle as a result of the accident, you should contact a personal injury lawyer who has handled cases like yours. They can give you some sense of what to expect and deal with the insurance companies. It is not a good idea to deal with the insurance company of the at-fault driver yourself.

Why? In short, the insurance company of the driver who is at fault is probably going to try to shortchange you on the settlement offer. If you get yourself a good attorney who deals with the insurance company directly, not only will you likely receive a higher settlement offer, you will also have a decent chance at a successful suit.

What should I do if I am the guilty party?

If you rear-ended someone in Texas, the possibility that you’ll be found liable is rather high. It is always a good idea to hire legal counsel to represent you if you find yourself on the wrong end of a civil lawsuit, because a case like this can drag on for months if not years.

There are ways that you and your attorney can put together a case to argue that you weren’t at fault:

If the car that you struck stopped suddenly, in a move that is illegal on the road, you could make a case that you are less than 51% at fault, or even not at all at fault
If the driver you struck drove erratically, swerved in front of you, you have a stronger case
If the other driver was intoxicated, your case becomes quite a bit easier. However, even if the other driver is arrested for a DUI, you may still want to retain outside counsel to ensure that you can recover as much damages as possible.
You may also be able to demonstrate a mechanical failure in the car, such as a sudden brake problem or electrical issue that rendered braking impossible

No matter who is at fault in an accident, your attorneys may still be able to negotiate a better deal for you. A lawyer will also be able to give you an accurate value of the damages so you won’t be left short of what you need to cover the bills.

In his 20^th studio album, “Letter To You,” the esteemed songwriter and the E Street Band make a powerful return to rock ‘n’ roll with 12 new tracks that touch on the great mysteries of life and death, the shedding of past lives, the passage of time and looking forward.

The following are excerpts from ATM’s October/November 2020 cover story featuring Bruce Springsteen, written by Editor in Chief Bob Love. The issue is available in homes starting in October and available online now at www.aarp.org/magazine/.

On his return to writing rock and roll songs:

“It’s part of the anxiety and mystery of the job that I do – which is a magic trick, because you take something out of the air that isn’t there… You can go for long periods without picking up anything significant. Or you’ll just pick up different things. It’s like you’re in a mine and one vein has gone dry, so you tap into another. A pop vein or a folk vein, and so you start working there. … But because I am primarily a rock ‘n’ roll musician when I’m operating sort of at my peak—I like to…every once in a while, come up with some rock songs.”

On his long career:

“I heard something of mine from 1975 on a record the other day, and I said, ‘That was about seven or eight lives ago. It was a full and entire life of its own.’ And I lived that one, and it was a great one, and now I’m living another one. I lived a life where we raised our children. That life is gone now. Now Patti and I are living another life. So, you live a lot of lives over the course of your one life.”

On loss of loved ones:

“So, this idea is you don’t lose everything when someone dies. You do lose their physical presence, but their physical presence is not all of them, and it never was all of them, even when they were alive. Spirit is very strong. Emotion is very strong. Their energy is very strong. And a lot of this, particularly for people who are very powerful, really carries over after death. It’s like my friend George passes away and leaves me with all of these songs. Clarence passes away and leaves me with these songs. Danny passes away, leaves me with these songs. And what are songs but dreams, at the end of the day? It really is all my dreams that I put down on paper and on tape.”

On finding inspiration in today’s economic climate:

“You have your antenna out. You’re just walking through the world and you’re picking up these signals of emotions and spirit and history and events, today’s events and past remembrances. These things you divine from the air are all intangible elements: spirit, emotion, history. These are the tools of the songwriter’s trade before he even picks up the pen.”

On recording new album, “Letter To You”:

“We spent one week in the studio—five days—and cut the entire record. It was all live, no overdub vocals and just a few overdub instruments. It’s the first truly live, in-the-studio record of the band we’ve ever made.”

On self-care and therapy:

“The talking cure—it works. But you’ve got to commit yourself to a process. And I was pretty good at doing that. I enjoyed the investigative examination of issues in my life that I didn’t understand. I learned a lot and therefore was able to exploit what I had learned and turn it into a real life.”

On his post-pandemic plans:

“All I can tell you is, when this experience is over, I am going to throw the wildest party you’ve ever seen. And you, my friends, are all invited.”

As summer winds down and fall arrives, many find themselves itching for one last summer getaway, or rather, that first autumn weekend away. 360 Magazine was able to take advantage of such a trip, visiting Wisconsin’s Elkhart Lake this past September. Located in the heart of Kettle Moraine State Forest, Elkhart Lake is the ideal natural getaway, being home to lake activities as well as canopied hiking and biking trails.

Elkhart Lake, located on the east side of Wisconsin, is both a stunning sojourn into nature and also a historical destination. With a population just under 1000, the village maintains a cozy quality, with local shops, restaurants, and activities maintaining a small-town, yet polished feel. Yet during the summertime, the town swells and comes to life. First inhabited by the Potawatomi Indians, the name Elkhart stems from the description Native people had of the area that the lake resembled the shape of an elk’s heart. Native American culture can easily be explored in the area through local tours and at the Henschel’s Indian Museum. Elkhart Lake is also a significant historical destination in terms of its relationship to racing, reaching its peak in the mid 1950s.

Our stay at the Shore Club was nothing short of superb. The new owners, Tom and Kristin Pagel, have done an incredible job renovating the hotel. Renovations include adding updated technology to enhance guest stays such as Netflix, Alexa, a digital concierge through the Whisper app, and luxury motor sports for those interested. Peloton bikes will soon be available for the additional fitness convenience of guests. Furthermore, the site also boasts an indoor pool, a game room with ping pong tables and vintage arcade games, and a gym. For those interested in seeing Elkhart Lake on two wheels, free bikes are available for guest use at the front desk. The restaurant on-site, the Cottonwood Social, offered consistently well-done meals, including the perfect weekend brunch.

We began our lake escape with a pontoon cruise on the namesake of the area, Elkhart Lake. Before departing, we sipped and snacked on the Osthoff’s signature cocktails and hors d’oeuvres. On the pontoon boat, we were able to view the lake’s crystal-clear lake waters and receive a tour that included information of the area’s history, legends, and folklore. The evening air aboard the boat made this the perfect way to begin a stay. Following the pontoon ride, dinner at the Osthoff Resort’s newest restaurant, Concourse Restaurant and Lounge, proved to be a unique culinary experience. With specialties such as honey balsamic trout, seared scallops with sweet pea risotto, and veal schnitzel with pickled cucumber relish, there was a delicious and refined option for every set of tastebuds. The restaurant’s décor, a tribute to the area and Osthoff’s vintage racing roots, also deserves special note.

Elkhart Lake is famed for its historic roots as a racing circuit in the 1950s. During this decade, the village of Elkhart Lake transformed into an open-road race circuit where top sports car drivers traveled from all around the world to take on the unique terrain. Likewise, thousands of fans were drawn to the area, eager to see the athletes and vehicles alike. The racing today is focused at Road America. The historic circuit is marked with signs denoting Wacker’s Wend, Kimberly’s Korner, and Dicken’s Ditch. This auto focused tour of the area isn’t to be missed. Road America also offers an opportunity to join in on the fun with options such as go-karting and ATVs at this world-acclaimed facility.

Road America and Elkhart Lake are famous as one of the oldest, largest, and most iconic tracks in the world. Currently, its original course is registered on the National Register of Historical Places, emphasizing its significance. Gaining popularity in the 1940s and 1950s, the post-World War II economy spurred on the influx of sporting luxury automobiles. For Elkhart Lake specifically, the notable Sports Car Club of America was the main organizer of their races. Incredibly popular races such as the RoadAmerica 500, SCCA National Sports Car Championship, the United States Road Racing Championship and the IMSAGT Championship took place here. Today, it continues to host luxury races and draw motorsports fans and can even be found in numerous racing video games!

Following a wild time racing, spend time winding down at the Aspira Spa. Inspired by local Native American practices and traditions, the spa has fused these with modern technology, science, and comfort. The inside space of the Aspira is thoughtfully designed and embraces the concept of Feng Shui as well as the natural elements. 360 recommends the Element Facial. This facial features a mask focused in traditional Chinese medicine representing the five elements: wood, fire, earth, metal, and water. Harmony can be restored through the combination of colored light and essential oils inspired by these elements. Travel back in time once again with a visit to the Carriage Museum at Wade House – back to the 1860s stagecoach era located within this Wisconsin Historical Site. To get a full experience of the period, we were able to travel in a horse-drawn carriage! The museum also features Wisconsin’s most diverse collection of transportation of this kind with over 100 horse-and-hand drawn vehicles. For the transportation enthusiasts, this isn’t to be missed.

When one thinks of wine country, Wisconsin might not exactly spring to mind. Yet award-winning sommelier Jaclyn Stuart operates Vintage Elkhart Lake, a charming shop where she hand-selects all wines available. The tasting at her bar came paired with cheese plates, potato chip flights, and other delectable pairing bites. The shop, beyond wine unique to the area, also sells other local delicacies for those interested in bringing home a taste of Wisconsin.

It would hardly be a trip to Elkhart Lake without time spent fishing. Elkhart Lake is 119 feet deep and 292 acres wide, providing the perfect home to a variety of fish species: musky, walleye, northern pike, largemouth and smallmouth bass, yellow perch, bluegill and crappie. Going with a licensed guide like Jay Brickner will aide in explaining all of those numerous species. Below the surface isn’t the only place to find remarkable species – a variety of endangered bird call this estuary home including bald eagles. Whether or not fishing is an interest, time spent on this beautiful, blue lake is worth taking a boat out for. Closer to shore also boasts some of the lake’s best charms. From the time when Native Americans lived along its banks, Elkhart Lake’s pristine quality has been appreciated. Taking advantage of more advanced activities like a hydrobike or other watersports can be a more adventurous way to embrace lake life. Other options include standup paddleboard, jet skis, and speedboats. Even taking a walk in the sand along the shoreline is a great way to embrace all the lake has to offer.

The natural beauty of Elkhart Lake is its most obvious draw, but the culinary scene isn’t to be underestimated. Lake Street Café, serving California Bistro style fare, also offers Wisconsin’s third largest wine list ensuring the perfect pairing for any dish. Quit Qui Clubhouse features classic pub and grill fare with a Wisconsin twist, including homemade soups, chili, sandwiches, burgers, and more. Sieb kens Resort and 67 Saloon are also phenomenal dinner options reflecting inspiration from the area.

Elkhart Lake proved to be a much-needed September getaway. The natural beauty paired with the historical aspects of the Native American culture, coupled with the scene of luxury racing and delectable eats makes this an incredibly well-rounded destination.

Netflix – The Take

Netflix has fixed a technical issue that left many viewers confused while watching one of the streaming service’s latest releases.

The 2016 film The Take starring Idris Elba was added to Netflix’s library Wednesday. The partly-French film had a bug with the subtitles where only the English lines were captioned and the French lines remained untranslated.

Subscribers quickly took to Twitter to alert Netflix of the issue. One user wrote, “Okay just finished The Take on Netflix and I’m very confused as to why the English subtitles were not included. Half the movie was in French.” Another said, “You can’t watch The Take on @Netflix unless you are past Level 5 French on Rosetta Stone.”

Despite this issue, the film currently holds the no. 3 spot in the Netflix ‘Top 10,’ sitting higher than the streaming service’s most recent original film The Devil All The Time. Netflix resolved the problem as of Monday afternoon and the movie now includes translations of the scenes in French.

The film— known internationally as Bastille Day, according to Essence— stars Idris Elba and “Game of Thrones’” Richard Madden. Forbes reports that the film was set to be released in Europe in early 2016, but was pushed back later in the year due to the 2015 Paris terrorist attacks. It was pulled out of theaters days after its July release due to the truck attack in Nice.

The film was not popular in the U.S., as it was only shown in 100 theaters nationwide. It earned just over $50,000 from its release in the states.

According to television and film news outlet Looper, the action film is about a pickpocket (Richard Madden) who steals a woman’s bag that contains a bomb, intended to go off in an empty building. He disposes of it and the explosion kills four people. He is then taken into custody by a CIA agent (Idris Elba), who quickly realizes that Madden’s character did not mean to take part in the attack. They learn that it was part of a plan by a group of corrupt police officers to rob the French National Bank. The two team up to clear the pickpocket’s name and stop the officers.

Despite the criticism over incorrect subtitling, it seems that the movie is finally getting the attention that it missed during its original release in 2016.

360 Magazine Marches on Washington

Recently, our team journeyed to Washington, D.C. for the National Action Network’s Commitment March. The August 28 march marked 57 years since the March on Washington where Martin Luther King Jr. gave his historic “I Have A Dream” speech. According to the National Action Network’s website, the goal of the march was to advocate for comprehensive police accountability reform, promote participation in the Census and motivate voters to cast their ballots in the upcoming Presidential election.

The National Action Network was founded by Rev. Al Sharpton in 1991. With nearly 100 chapters nationwide, the civil rights organization works in the tradition of Martin Luther King, Jr. to achieve “one standard of justice, decency, and equal opportunities for all people regardless of race, religion, ethnicity, criminal record, economic status, gender, gender expression or sexuality.”

The trip from New York to Washington, D.C. was made easy by taking Amtrak’s Acela service. Despite the higher price point, the Acela is newer and less crowded than regional trains. The express train eliminated the burden of tolls and stopped in only a few cities, arriving in D.C. after about three and a half hours. It can be stressful to travel right now, so it was a relief to see how clean the train was. The quiet car, basic free wifi and outlets on board provided the perfect environment to research and write articles on our tablets. We utilized our extra time to discuss with one another and prepare for our coverage of the march and our days in D.C.

The café offered coffee and various snack options, and the sliding glass doors made it easy for us to walk through the cars. The reclining seats were comfortable and allowed us to rest before our trip. There were also sections of four seats for those traveling in a larger group. Each passenger could bring two personal items weighing up to 25 pounds, and two carry-on bags weighing up to 50 pounds at no additional cost. Amtrak is currently offering reduced fares for two to six tickets purchased together where riders can save eight to 45 percent.

Luckily, we were able to call Amtrak in advance to ensure we could carry on our folding bicycles. With limited parking available in the city, electric bikes served as a great mode of transportation for many protesters. E-bikes such as the DYU Smart Bike and a custom scooter from Good Vibe Gliders were an affordable alternative to renting a car, and made covering and participating in the march much easier.

The Commitment March: Get Your Knee Off Our Necks started early Friday morning. Participants marched through the National Mall, many carrying signs remembering those whose lives have been lost in acts of police violence. Others displayed “Black Lives Matter” on flags, shirts and masks.

Some participants created street art during the event, voicing their support through their work. At one point, a number of demonstrators stood together in the Reflecting Pool in front of the Washington Monument. Marchers reached the section of 16 Street NW that has become known as “Black Lives Matter Plaza” around 3:30 PM before dispersing for the day.

Organizers of the march upheld COVID-19 guidelines and regulations. The National Action Network placed multiple signs throughout the National Mall encouraging social distancing, and took marchers’ temperatures as they entered the area. Face masks were distributed to people who did not have one, and visitors from high-risk areas were urged to join virtually from their homes. There was also a testing booth on site, as reported by WUSA 9.

The march was co-convened by Sharpton and Martin Luther King III. Among the thousands of attendees who gathered on the National Mall were the families of George Floyd, Breonna Taylor, Trayvon Martin, Eric Garner and Jacob Blake. Many members of these families gave speeches at the Lincoln Memorial, along with lawmakers from across the country. These congressmen and women pushed for legislation that would address cases of racial injustice.

Though she was not present, Vice Presidential candidate Kamala Harris shared her message to marchers via Twitter. In her speech, which was played at the event, she said, “…if we work together, to challenge every instinct our nation has to return to the status quo, and combine the wisdom of long time warriors for justice, with the creative energy of the young leaders today, we have an opportunity to make history, right here and right now.”

Yolanda Renee King took the stage to address the crowd, standing where her grandfather had led March on Washington for Jobs and Freedom. In a video posted by CNN she said, “We stand and march for love and we will fulfill my grandfather’s dream.” She then led a chant of “Show me what democracy looks like; This is what democracy looks like!”

Friday was also the 65th anniversary of Emmett Till’s murder. The 14-year-old was lynched and thrown off a bridge while visiting family in Mississippi. He was abducted after “allegedly whistling at a white woman,” according to ABC 7 Chicago, and his body was found mutilated in the Tallahatchie River. Till’s family never received justice, as the two men responsible for his death were both acquitted. Till’s murder helped to spark the Civil Rights Movement in the 1950s. Civil rights leader and former congressman John Lewis wrote that “Emmett Till was [his] George Floyd” in a New York Times essay that was published on the day of Lewis’ funeral.

The trip provided a meaningful experience to stand in solidarity with the Black Lives Matter movement, as well as time to see local relatives. 360 President Vaughn Lowery visited his uncle Leroy Lowery, the former executive director of the Martin Luther King Jr. National Memorial Project Foundation, who raised over $120 million for the Stone of Hope.

Leroy Lowery is the son of the late Rev. Joseph E. Lowery, a civil rights leader who helped Martin Luther King, Jr. establish the Southern Christina Leadership Conference, and received the Presidential Medal of Freedom in 2009. Leroy Lowery attended the march with his father in 1963 and stated on Friday, “to see that we have to march [again] 57 years later is deflating.”

Mika – I Love Beirut

Today, Mika announces the ‘I love Beirut’ benefit concert, which will be performed on Saturday 19 September and will be live-streamed across four time zones via YouTube. Tickets cost £10 / $10 / €10 and will be available from TicketMaster alongside the GoFundMe campaign, where people can make additional donations to the cause with 100% of all proceeds being split across Red Cross Lebanon and Save the Children Lebanon. Tickets go on sale at 9am BST / 10am CET on Monday 24 August.

This intimate performance has been initiated by Lebanese born singer Mika after he was profoundly affected by the scale of devastation from the explosion in Beirut docks and its impact on the people of the city. Following on from his ‘Love Letter to Beirut’ (see note to editors below) which he wrote directly in the aftermath of the explosion. In an effort to do more he has created ‘I Love Beirut’ an event to raise funds to help those who have been affected by the devastating explosion.

Mika comments: -“After all the years of civil war, financial crisis and political upheaval, the news of the tragic explosion was unbelievable. Although far away, my heart broke for the families losing their homes, their livelihoods and their loved ones in this catastrophe. I wanted to do something to help in any small way I can. That is why I am staging a live stream concert in aid of the people of the city. Beirut has been through so much and the resilience and strength the Lebanese people is undeniable. I have no doubt that the city will recover and the unique life of this magical city will resume once again. Beirut is the place of my birth, is part of me and will always be in my heart. ‘I ❤️ Beirut’.

The Lebanese United Nations team has reported the explosion was like 15 years of war in 15 seconds, comparing its impact to the devastation from the country’s civil war that lasted from 1975 to 1990. Miles from the blast site apartments are wrecked and families left homeless. It’s estimated 300,000 people do not have homes fit to live in, as Lebanon now has to undertake a single recovery effort of unprecedented scale.

Hospitals in Beirut are now overrun with wounded people, with some being referred to Tripoli, 50 miles to the north of Beirut, for treatment. The destruction of Beirut’s port will devastate the country further as it relies heavily on imports for its essential supplies. Red Cross Lebanon, Lebanese Food Bank, Islamic Relief and Save the Children Lebanon. are working around the clock to help those on the ground affected by the blast. Donations will fund immediate emergency response and wider long-term rehabilitation.
