Can Biden Fix the Courts That Trump Broke?

There is no progressive future without a serious fight to reclaim the judiciary from the grips of conservative judges.

In The Nation’s latest cover story, justice correspondent Elie Mystal explains:

“While previous Republican administrations tried to break government, Donald Trump tried to break democracy. He did this boldly and brazenly, by attacking elections, and he did it less boldly but no less brazenly, by working alongside Mitch McConnell to take over the unelected branch of government that sets the rules for all the others: the federal judiciary. That branch is now stuffed with conservative ideologues masquerading as jurists.”

Making the case that there is no progressive future without a serious fight to reclaim the judiciary from the grips of conservative judges, Mystal evaluates whether Biden can fix the courts that Trump broke: Happily, there is a solution, and that solution is to expand the lower courts.

Congress has used its constitutional authority throughout history to expand the federal judiciary. Historically, these lower court expansions were bipartisan: As the country grows in population, so does the number of lawsuits. Adding judges is just a thing we used to do to keep the judiciary running smoothly. But since 1990, when the last judgeship bill was passed, the US population has grown by a third; the number of district court cases has grown by 38 percent; and the number of cases involving a felony defendant has grown by 60 percent. The number of judges has not changed.

“I absolutely believe that if Trump had won reelection and McConnell had hung onto the Senate, Republicans would be working on court expansion right now,” writes Mystal. “There just aren’t a lot of vacancies left in the federal judiciary. Republicans can always find some casus belli for stacking the courts with conservative judges. The only question is whether Democrats will ever realize there’s a war, and they’re losing it.”

“To balance out decades of inequity, Biden’s judicial appointments shouldn’t ‘look like America;’ they should overrepresent the kinds of Americans routinely excluded by Republican administrations,” he continues. “You can’t balance a seesaw by standing in the middle when an elephant is sitting on one side.”

The Dugger Law Firm, PLLC Has Filed a Sexual Orientation, Atheism, and Disability-Based Harassment Case Against L’Oreal USA, Inc. on Behalf of Rafael Sanchez

On April 13, 2021, Rafael Sanchez filed a federal complaint in the Southern District of New York, alleging New York City Human Rights Law (“NYCHRL”) sexual orientation, Atheism, and disability-based harassment and hostile work environment claims, as well as aiding and abetting of discrimination claims, against L’Oreal USA, Inc. (“L’Oreal”). Rafael Sanchez is being represented by The Dugger Law Firm PLLC.

L’Oreal hired Plaintiff as a makeup artist and skincare consultant during approximately December 2017, through staffing company Randstad Professionals US, LLC.

Mr. Sanchez alleges that L’Oreal, through its long-time Business Manager Viviana Nunez (“Nunez”), engaged in discriminatory harassment and created a hostile work environment based on Mr. Sanchez’s status as a gay male, non-religious Atheist, and/or disabled person.

Mr. Sanchez’s complaint seeks compensatory damages, punitive damages, declaratory relief, injunctive relief, attorney’s fees, expert fees, costs, and interest.

The case is Sanchez v. L’Oreal USA, Inc., No. 1:21-cv-03229, in the United States District Court for the Southern District of New York.

A Gripping Military Horror with Shocking Supernatural Twists

Q&A WITH ERIC LELAND:

AUTHOR OF Inhuman MILITARY THRILLER DEBUT

Question: What inspired you to write Inhuman?

Eric Leland: During a class for my MA I wrote a 25-page short story titled Recon Team: Mercury. That story was shortened to five pages and is now the prologue to Inhuman. For a NaNoWriMo idea I thought it would be interesting to see what happened when the rescuers came looking for the team that disappeared in my original short story. Inhuman is the result.

Q: What sets Inhuman apart from other military and horror books?

EL: The bravado one comes to expect when reading military fiction is quickly ripped away to expose and pick at the delicate flesh of fear and self-doubt we are ashamed to admit exists.

Q: What do you hope readers will take away from the book?

EL: It was never my intent for Inhuman to be didactic. Primarily I hope readers are entertained. I hope readers will remember the experience of Inhuman rather than any particular lesson.

Q: Inhuman features a diverse cast of characters. How did your military friendships, and experiences with “Don’t Ask, Don’t Tell,” inform this inclusivity?

EL: A diverse cast adds verisimilitude to military fiction simply because any U.S. military unit features a diverse roster. In my first combat experience I found myself fighting shoulder to shoulder with Mexican Americans, an African American, and a gay woman. Unfortunately, DADT was still a thing for most of my military career and I would only find out after DADT was repealed that some of my greatest friends were gay. I think truth in fiction is important, and if I did not write a diverse cast I would by lying. Readers can spot a lie from a mile out.

Q: How did you develop your characters? And which of them do you have the strongest connection to?

EL: The character Jaran is heavily based on my wife’s experiences who was born in Vietnam. At an early age, she and her family fled to a refugee camp after the war. The chaos of displacement during war time seemed terrifying. I can’t really say which character I have the strongest connection to—John’s sense of duty; Chris’s refusal to take anything seriously; and Brandon’s severe depression and self-doubt—they’re all variations of me.

Eric Leland grew up in Massena, NY and entered Army basic training upon high school graduation. He was an MP in the Army for six years and reclassified to a Special Agent with the Army Criminal Investigation Division. Eric deployed to Honduras in 2002, and Iraq in 2003 and 2009 where he was awarded an Army Commendation Medal with “V” device for valor. He completed his MA in Creative Writing from Southern New Hampshire University and has happily traded in his gun for a pen. Eric lives in Seattle with his wife. Polestar Raises $550 Million

Polestar Raises $550 Million from New Investors; Further Fundraising Considered

Polestar, the Swedish electric performance car company, has raised $550 million (USD) from a group of long-term financial investors.

The private placement of newly issued shares marks the first-time external investors have backed Polestar’s products, brand, industrial capability, financial ambitions and high growth potential.

The new investments come as the global market for electric cars is growing strongly, with consumers increasingly prepared to combine e-mobility with their environmental aspirations. Simultaneously, the technology behind electric cars is advancing and becoming more economical, making mass consumer adoption of electric vehicles an imminent reality.

These factors led to Polestar attracting considerable interest from a range of external investors as part of its fundraising activities. Polestar also confirms it is in ongoing discussions with global investors about possible additional fundraising. Full financial details of the transaction are not being disclosed at this stage.

The group of investors is led by Chongqing Chengxing Equity Investment Fund Partnership, Zibo Financial Holding and Zibo Hightech Industrial Investment. They have been joined by I Cube Capital, an arm of SK Inc., the South Korean global conglomerate, and a range of other investors.

The new investment sets the stage for future growth by diversifying Polestar’s funding structure. It deepens the pool of resources available to accelerate product development and technological capabilities ahead of launching several ground-breaking cars in the coming years.

Since the brand’s launch in October 2017, Polestar has developed its own high-quality manufacturing facility in China, built a global sales and distribution operation, and successfully launched two vehicles – Polestar 1 and Polestar 2 to extremely positive customer feedback and media reviews.

“Our new investors have recognized that Polestar offers an alluring combination of established industrial and technological capability alongside superlative growth potential as the global auto industry goes electric,” said Thomas Ingenlath, CEO of Polestar.
